PUPPY PURCHASE CONTRACT FOR RILLITO CHIHUAHUAS
Puppies are sold as pets and companion animals unless otherwise contracted in writing. This agreement is a legal document between the buyer and the seller. The buyer agrees that he/she has read and understands this agreement and no other guarantees or warranties have been made either expressed or implied by the breeder/seller. There are no binding amendments unless in writing.
It is the buyer's responsibility to have this puppy examined by a licensed veterinarian of their choice within 3 days of taking possession of this puppy. If the puppy is found to have a life threatening congenital defect (heart, kidney, lung, neurological) a replacement puppy of equal value will be given once the original puppy is returned. The cost of the puppy (excluding transport) will be issued as a credit toward the purchase of another available puppy.
NO REFUNDS: Seller is not obligated to refund part or entire purchase price unless puppy expires while in the care of the breeder. Deposits are never refunded if the buyer backs out of purchase of puppy for any reason, i.e.: buyer's remorse, health issues, flight delays, change in living arrangements._______initials.
Seller guarantees this puppy until one year of age (health warranty is contingent on NUVET supplementation, see below) against life threatening defects. Proof of fatal genetic defect is required and dog returned to breeder in order to receive credit of original price (excluding transport) toward a replacement puppy. In the unlikely event that this puppy expires during the first 12 months due to a congenital defect, a necropsy from a state veterinary lab confirming such event as the cause of death before any action is initiated by the seller. Necropsy is performed at buyers expense. In addition, a photo of the deceased puppy must be sent with the necropsy report to verify identification. Under no circumstances is this puppy to be euthanized without sellers knowledge and consent.
Buyer agrees to have a veterinarian examine this puppy within 72 hours of adoption and exam will include an office fecal exam testing for parasites and worms.
Seller will not be responsible for Parvo or Distemper virus occurring after 14 days of the sale as these are viral diseases and can be contracted after leaving my home. We implore common sense to the buyer to not take the puppy to public places or expose to other dogs/puppies outside your home until the vaccination schedule is completed. We use the Dr Dodds Protocol for puppy shots as recommended by the Chihuahua Club Of America. Please read my puppy care page to see their recommendations. Your puppy will have received age appropriate immunizations prior to coming home. Buyer will be provided with a health record showing immunizations provided to date. It is the buyers responsibility to complete the Puppy series. Remember vomiting and diarrhea can be symptoms of low blood sugar in a tiny toy breed puppy. If this occurs then you want to start treatment for hypoglycemia before heading to a veterinarian and keep in mind that some veterinarians are not familiar with these low blood sugar symptoms so ask that blood sugar be checked as well as the usual work up for these symptoms. Store snap tests are not conclusive once your puppy has received vaccines. For this reason we require that a fico glass slide test be done to rule out Giardia, E. coli, Campylobacter or Salmonella. This is a send out lab test but you should have results within 24 hours. It is usual for a puppy to be treated with IV or subcutaneous fluids and antibiotics for vomiting and diarrhea. Seller is not responsible for any incurred vet fees.
PLEASE NO VACCINES THE FIRST TWO WEEKS HOME. This is a stressful time with much change for a puppy so a bad time to administer booster shots. The vaccines Leptosporosis, Corona and Giardia should not be given to small breed dogs especially not before they are full grown. Seller reserves the right to pull this warranty if any of these three vaccines are given during the warrantee period. Seller is not responsible for a potential vaccination overload due to your vet doubting our records. This can make the puppy very ill or even cause death and over vaccination is believed to cause lifelong problems such as allergies or autoimmune disorders. Some vaccines are not recommended by the AVMA and it is best to follow current guidelines. Premedicating your puppy with Benadryl is helpful in reducing the risk of a reaction to vaccines. Please have your vet call me if he/she has any questions regarding the vaccines given.
Purchaser agrees not to hold the seller responsible for any veterinary fees or medical expenses incurred for this puppy regardless of cause. You may return the puppy at any time during the warranty period for a credit of the original purchase price minus transport cost toward another puppy if there is proof of a life threatening genetic defect. We do not warranty non genetic health problems nor do we replace or give credit for genetic issues that are not life threatening including cosmetic defects such as ear shape or size, color of coat, tail length, size and weight, skin pigment or condition nor for fertility of female or male including testes. We do not warranty against moleras as these are a normal part of the chihuahua breed standard. We also do not warranty against luxating patellas grade one or two as this will not have any significant effect in this puppy's life. If the luxation is grade 3 or 4 we give the option to return the puppy as long as the puppy is under 1 year old. We will have our vet evaluate and perform corrective surgery at our cost if needed. You can then have your puppy return to you or receive a credit toward a new puppy. We will not be responsible for any expense incurred by you if you have your veterinarian provide surgery or other services for this. Luxating patellas can be environmental from injury of the tiny groove that holds the kneecap in place. Never allow a small breed dog to jump off any furniture; "if they can't jump onto it then don't let them jump off of it" works well to help prevent this type of injury. My breeding adults are health tested to decrease the likelihood of genetic faults occurring.
Any dog bought from us may be returned to us at owners expense for rehoming. Puppy is not ever to be surrendered to an animal shelter. _______ initials
Pet puppies will not come with their AKC registration papers, no exceptions. If a puppy is bought with full AKC then their registration application will come with the puppy or be mailed within 30 days of purchase. All registered puppies bred by and sold by Rillito Chihuahuas will have the prefix RILLITO in their registered name.
NuVet Supplementation is required in order to keep your puppy's health warranty.
If NuVet is not purchased the first week after acquiring your puppy then this health warranty expires 14 days after you take possession of your puppy. Puppies organs, bones and brain grow very rapidly during their first year of life. This supplement ensures you are doing your best to maintain their health as well as build up the immune system. Your puppy will come with an 8 to 12 day supply and ordering information, 1-800-474-7044, order code 33589. Using this number to order is less than the cost in vet offices and it is not available in stores. 1/2 wafer daily is the dose recommended for a toy breed adult. I recommend 1/4 wafer daily for puppies.
State laws allow contract agreements between buyer and seller as long as reasonable options of resolution exist should a health issue arise. Seller does not offer a cooling off period on our puppy sales. Buyer remorse is not tolerated. Deposits are forfeited if buyer backs out of this sale for any reason.
Buyer in this contract will include married couples under one spouse signature.
No disagreement is ever expected, but if any disagreement arises it will be settled by a court in Pima County, state of Arizona. You must decide if our terms presented here are reasonable to you. If you do not find our terms fair and do not agree to these terms then do not send a deposit or payment to purchase a puppy from us. Regarding shipping: We prefer that you personally come to meet your puppy but if that is not possible then you can elect to have an agent stand in for you and have your puppy flown in cabin to your airport. This can be any person you the buyer approves and I can offer help with this if you are unable to come to my home.
